The use of the Griffiths Question Map for the Analysis of Interrogations Proceeded by Courts – a Case Study of Lawyer’s Interrogation Technique

Popis: Namen prispevka: Namen prispevka je na podlagi analize primera iz sodne prakse ugotoviti, kakšne vrste vprašanj je odvetnik med navzkrižnim zaslišanjem mladoletne priče najpogosteje uporabil in kako je izbira le-teh vplivala na odgovore zaslišane osebe. Metode: Z analizo vsebine pisnih virov smo pregledali strokovno literaturo o tehnikah in strategijah policijskega ter sodnega zaslišanja, nato smo analizirali, kako lahko navzkrižno zaslišanje vpliva na odgovore zaslišane osebe, in preučili tehniko analize vprašanj, imenovano Griffithsova shema vprašanj. S pomočjo Griffithsove sheme vprašanj smo analizirali prepis zvočnega posnetka zaslišanja priče. Ugotovitve: Na podlagi analizirane literature s področja zasliševalskih tehnik in rezultatov analize prepisa zvočnega posnetka zaslišanja priče smo ugotovili, da je bila priča v analiziranem primeru sodnega zaslišanja podvržena nestrokovno izvedenemu zaslišanju. Na podlagi rezultatov analize sodnega zaslišanja priče lahko sklepamo, da izpraševalcu primanjkuje znanja o osnovnih spoznavnih procesih, predvsem o delovanju spomina, ki je pri pričanju ključen. Omejitve/uporabnost raziskave Omejitev prispevka je dejstvo, da je bila analiza zaslišanja s pomočjo Griffithsove sheme vprašanj opravljena samo na enem primeru sodnega zaslišanja, zato ugotovitev statistično ne moremo posplošiti na celotno populacijo. Kljub temu nam ugotovitve omogočajo pregled nad stanjem in opozarjajo na vrzeli v izobraževanju ter usposabljanju odvetnikov s področja izvedbe učinkovitega in etičnega zaslišanja. Praktična uporabnost: Raziskovalne ugotovitve se ujemajo z ugotovitvami drugih raziskav o pomanjkljivostih izvedbe sodnih zaslišanj. Izvirnost/pomembnost prispevka: Prispevek pomeni prvo analiziranje prepisa zvočnega posnetka sodnega zaslišanja priče s pomočjo analize Griffithsove sheme vprašanj v slovenskem jezikovnem in kulturnem prostoru. Prispevek je pomemben za ozaveščanje domače strokovne javnosti o obstoju problematike morebitnih pomanjkljivosti izvedbe sodnih zaslišanj. Purpose: The purpose of this article is to determine which questions a lawyer was using most commonly during cross-examination of juvenile witness and establish how the choice of those questions influenced the interrogated person. Design/Methods/Approach: We analysed academic literature and legislation that covers techniques and strategies of police interrogations amd interrogations proceeded by courts. Later we analysed the effect that a cross-examination-style questioning has on witnesses’ responses and studied the question analysis technique named Griffiths Question Map. Finally, based on analysis of academic literature, we used Griffiths Question Map to analyse the transcript of the sound recording of witness interrogation. Findings: Based on analysed literature in the field of interrogation techniques and the results of the transcript we concluded that the witness was subjected to unprofessionally performed interrogation. Based on the results of interrogation analysis we conclude that interrogator lacks knowledge of basic cognitive processes, especially regarding memory work, which is of vital importance in witness testimony. Research Limitations / Implications: Limitation of the article is the fact that analysis of interrogation with the help of Griffiths Question Map was carried out and based solely on one case of interrogation proceeded by courts, which is why we cannot statistically generalize our findings to the whole population. Nevertheless, our findings do enable a better overview of the situation and point out that there are gaps in education and training of lawyers, which show in inefficiently and unethically carried out interrogations. Practical Implications: Our research findings support other findings regarding imperfections in conducting interrogations proceeded by courts. Originality/Value: Our research presents the first analysis of the transcript of witness interrogation with the help of the analysis of Griffiths Question Map in Slovenian linguistic and cultural space. It is important for making the local professional public aware of imperfections in conducting interrogations proceeded by courts.
