Popis: | Priznanje in izvršitev tujih stvarnopravnih zavarovanj na premičninah v jugovzhodni Evropi Ne glede na nekatere nove tendence oz. ureditve v mednarodnem stvarnem pravu ali na nadnacionalni ravni, velja v državah nekdanje Jugoslavije za vse stvarne pravice (vključno z neposestnimi stvarnopravnimi zavarovanji) le klasično kolizijsko pravilo lex rei sitae. V pravni ureditvi tako ni razlikovanja med ustanovitvijo, učinki proti tretjim ter prioriteto v razmerju do ostalih imetnikov stvarnih pravic na isti stvari. V zvezi s tem Bosna in Hercegovina predstavlja izjemo, saj sprejema posebne zakonodajne rešitve za reševanje t. i. conflict mobile za čezmejna neposestna stvarnopravna zavarovanja. Bosansko- hercegovske rešitve, ki sicer izrecno omogočajo preoblikovanje tujih stvarnopravnih zavarovanj v njihov bosansko-hercegovski ekvivalent in njihovo novo registracijo v BiH, rešujejo zgolj majhen del kompleksne problematike imenovane conflit mobile na področju čezmejnih neposestnih stvarnopravnih zavarovanj. V zvezi stem bi bila potrebna korenitejša reforma kolizijskih pravil, po možnosti po UNCITRAL-ovem modelu, četudi bi to pomenilo, da bi bilo treba sprejeti obsežna in kompleksna kolizijska pravila. Obseg kolizijskih pravil je tudi znamenje, da na tem področju obstajajo številne težave. Pri tem se ne sme spregledati, da bi imela rešitev le-teh izjemen pomen na področju kreditiranja in učinkovtejše izterjave dolgov. Regardless of some new trends or rules of the international property law, or at the supranational level, in countries of the former Yugoslavia applies for all property rights (including the non-possessory security rights in rem) only the classical collision rule lex rei sitae. There is no differentiation between the creation, effect against third parties and priority in the field of property rights in general as well regarding non-possessory securities. In this regard, Bosnia and Herzegovina represents an exception, where the specific solutions for so called conflit mobile regarding cross border non-possessory securities have been accepted. It was suggested that also the Bosnian-Herzegovinian solutions, that explicitly allow a transposition (conversion of the security right created abroad into an equivalent right in Bosnia-Herzegovina) as well as new registrations, solve only a small part of the problem-complex named conflit mobile in the field of cross border non-possessory securities. Therefore a revision of provisions would be necessary, if possible according to the UNCITRAL model, even if this would mean to accept very extensive and complex conflict rules. This could also be a sign that a large number of problems are hidden in this field. It should be borne in mind that their solution would be of significant importance in the field of lending and efficient enforcement of debt collection in the region. |
