V diplomskem delu je predstavljen pojem revizije kot izredno pravno sredstvo, predvsem v praksi Vrhovnega sodišča Republike Slovenije (v nadaljevanju Vrhovno sodišče RS). Za lažje razumevanje je na začetku diplomskega dela opredeljen pojem pravnih sredstev. Navedena so tudi redna in izredna pravna sredstva in pojasnila, v čem se redna razlikujejo od izrednih pravnih sredstev. V drugem delu diplomske naloge se bom osredotočila na pojem revizije, razložila, katere so funkcije revizije, dotaknila se bom pojmov dopustnosti in dovoljenosti revizije, naštela bom revizijske razloge in predstavila, kako postopek z revizijo poteka. Osredotočila se bom tudi na pogoje, ki jih je potrebno izpolnjevati in upoštevati, da se revizija kot izredno sredstvo lahko uporabi. Poseben poudarek pri obravnavi revizije kot izrednega pravnega sredstva bom namenila tudi razlagi, zakaj le-ta ni zagotovljena z Ustavo Republike Slovenije , ki v 25. členu ureja pravico do pravnega sredstva, ampak marsikdo pozabi, da ta člen zajema le pritožbo ali drugo (redno) pravno sredstvo. Revizija pa je izredno pravno sredstvo ravno zato, ker omogoča poseg v pravnomočno odločbo sodišča, pravnomočnost pa je ustavnopravno varovan institut, ki ga ureja 158. člen Ustave RS, namenjen pa je varstvu pravnega reda s tem, da izključuje negotovost posameznika glede pravno urejenih razmerij, da prepreči ponavljanje postopka ter ponovno odločanje v isti zadevi, v kateri gre za isto stvar in za isto osebo, ne glede na to, ali je bila z odločbo zadeva pravilno rešena. V nadaljevanju bodo predstavljene tudi spremembe, ki jih je prinesla novela ZPP-D iz leta 2008, saj je reforma izrednih pravnih sredstev, revizije in zahteve za varstvo zakonitosti izhajala iz izhodišča, da mora Vrhovno sodišče RS skrbeti za razvoj in enotnost pravnega reda na splošno in s tem presegati pomen odločitev v konkretni zadevi. Zadnji del diplomskega dela bo obravnaval revizijo kot izredno pravno sredstvo v praksi Vrhovnega sodišča RS, s čimer bo predstavljen postopek in odločanje v zvezi z revizijo. Menim, da je predstavitev praktičnih primerov za boljše razumevanje samega pojma revizije kot izrednega pravnega sredstva nujna, saj bom tako najlažje prikazala kompleksnost ter različnost tega pojma od primera do primera. I will try to present revision as an extraordinary legal remedy, especially in the praxis of the Supreme Court, in my final thesis. Because the understanding of certain terms, linked to revision as an extraordinary legal remedy, is necessary for the understanding of my thesis, I will begin by explaining the concept of certain legal terms, defining which are ordinary and which are extraordinary and by explaining the difference between ordinary and extraordinary legal remedies. I will concentrate on the concept of revision in the second part of my thesis. I am going to describe which are the functions of revision and I will write about the concepts of admissibility and acceptability of revision. I will list the reasons for revision and present the procedure of revision. I will focus on the terms, which have to be followed and fulfilled for revision to be used as an extraordinary remedy. I will pay special attention to the explanation of why revision as an extraordinary legal remedy is not guaranteed by the Constitution of the Republic of Slovenia, which regulates the right to a legal remedy in Article 25, but many forget that this article only covers complaints or other (ordinary) remedies. Revision is an extraordinary legal remedy, because it allows an intervention in the court's final judgment and the legal effect of the court is a constitutionally protected institute, governed by Article 158 of the Constitution of the Republic of Slovenia. It is intended for the protection of the judicial rules in that it excludes the uncertainty of individuals towards legally regulated relationships and in that it avoids repeating the procedure and review of the decision in the same case, in which it concerns the same matter and the same person regardless of whether the matter was properly solved by a court's decision. I am also going to mention the changes of revision, which were introduced by the amendment of the Code of Civil Procedure (ZPP-D) in 2008, since the reform of extraordinary legal remedies, revisions and the requirements for the protection of legality arose from the fact that the Supreme court of the Republic of Slovenia has to take care of the development and the unity of the judicial rules in general and by that overcome the meaning of decisions in a concrete matter. I will dedicate the last part of my final thesis to revision as an extraordinary legal remedy in the praxis of the Supreme Court and in this matter present the procedure and the decision making regarding revision. I believe that the presentation of actual practical cases is necessary for the better understanding of the term revision as an extraordinary legal remedy, in which it enables me to show the complexity and diversity of the term from case to case. |
