Popis: | Diplomsko delo obravnava pravno ureditev odgovornosti staršev za otroke, predvsem z vidika odgovornosti za škodna ravnanja mladoletnih oseb po Obligacijskem zakoniku in pa sodno prakso v zvezi s to tematiko. Odgovornost staršev za otroke izhaja iz roditeljske pravice. Poleg skrbi za zagotavljanje osnovnih življenjskih potrebščin, so starši dolžni skrbeti tudi za otrokov skladen razvoj, za ustrezno vzgojo, nadzor, prav tako pod zakonsko določenimi pogoji odgovarjajo za škodo, ki jo povzroči mladoletnik. Odgovornost mladoletnika oziroma posledično odgovornost staršev se razlikuje glede na starostna obdobja mladoletnika. Prav tako so poleg starosti pri presoji odgovornosti v posameznem primeru pomembne osebnostne lastnosti mladoletnika, kot so zrelost, poslušnost, ipd. Odškodninska odgovornost se navezuje na deliktno sposobnost mladoletnika. Odgovornost staršev načeloma traja do polnoletnosti otroka. Starši odgovarjajo za ravnanje otrok, starih do sedem let, ne glede na svojo krivdo. Starši ne odgovarjajo, če je škoda nastala, medtem ko je bil otrok zaupan drugemu in je ta zanjo odgovoren (torej ni vršil ustreznega nadzora), odgovarjajo pa za škodo, katero povzroči drugemu njihov mladoletni otrok, ki je dopolnil sedem let, razen če dokažejo, da je škoda nastala brez njihove krivde. Če je poleg staršev za škodo odgovoren tudi otrok, odgovarjajo solidarno. Starši prav tako odgovarjajo v primeru slabe vzgoje, zgledov in slabih navad, ki so jih prenesli na svojega otroka in zaradi katerih je prišlo do povzročitve škode, lahko pa odgovarjajo tudi iz naslova načela pravičnosti. My paper focuses on the legal regulation of parental responsibility for children, especially in terms of liability for torts conduct of minors under the Code of Obligations and with the case law relating to this topic. Parental responsibility for children is a part of parental rights. In addition to caring for the provision of basic necessities of life, parents are obliged to care for the child's harmonious development, of appropriate education, supervision and, under the statutory conditions, are liable for damage caused by a minor. Liability of a minor or consequential responsibility of parents varies depending on the ages of the minor. Very important, in addition to age, in assessing liability in a particular case are also personal characteristics of the minor, such as maturity, obedience, etc. Liability for damages relates to the ability of tort minor. Parental responsibility in principle lasts until the child reaches majority. Parents are responsible for the behavior of children aged up to seven years, regardless of their guilt. Parents are not liable if the damage is caused while the child was entrusted to another and they are responsible for the minor (lack of proper supervision). Parents are liable for damages, however, which were caused by their child who has attained the age of seven, unless they can prove that the damage was caused without their guilt. In addition, parents can be jointly and severally liable. Parents are also liable in the event of poor education, poor examples and bad habits that they transferred to their child and they may also be liable under the principle of fairness. |
