The new Croatian law on general administrative procedure as a leaver of public sector modernisation

Popis: Opisuje se proces nastanka i struktura novog hrvatskog Zakona o općem upravnom postupku. Smatra se da je novi Zakon izraz konzervativnijeg pristupa koji vodi više računa o hrvatskoj tradiciji i postojećem stanju hrvatske javne uprave, a manje o potrebi njezine modernizacije. Pobliže se analiziraju neka rješenja novog Zakona u odnosu na Direktivu o službama u unutarnjem tržištu Europske unije iz 2006. (upravna simplifikacija, jedinstveno upravno mjesto, elektronička komunikacija, itd.). Posebna je pažnja posvećena institutu upravnog ugovora. Zaključuje se da novi Zakon ima nedovoljan modernizacijski potencijal.
The author describes the process of drafting and the structure of the new Croatian Law on General Administrative Procedure. It is considered that the new Law is a result of conservative approach that takes more care of Croatian tradition and the current state of the Croatian public administration than of the necessity of its modernisation. The paper contains a detailed analysis of certain solutions of the new Law compared with the EU Directive on Services in the Internal Market of 2006 (administrative simplification, the point of single administrative contact, electronic communication, etc.). Special attention is given to the institute of administrative contract. It is concluded that the new Law has insufficient modernisation potential.
