La Ley 17/2021, de 15 de diciembre, de modificación del Código Civil, la Ley Hipotecaria y la Ley de Enjuiciamiento Civil, sobre el régimen jurídico de los animales ha abordado cuestiones que cada vez eran más frecuentes en nuestros tribunales y que afectaban a la relación que une a los animales y a las personas. En este contexto, esta norma ha introducido cierta previsión legal que reconoce el daño moral de los propietarios o convivientes del animal cuando se produzca la muerte o lesión física o psíquica de este. A partir de tales premisas, el presente estudio tiene por objeto el análisis del apartado 4 del artículo 333 bis del Código Civil. A estos efectos, se analizarán los presupuestos para su aplicación, así como las principales novedades que presenta esta disposición frente a la situación anterior. The Act 17/2021, 15th December, amending the Civil Code, the Mortgage Act, and the Civil Procedure Act, on the legal regime of animals has addressed issues that were increasingly frequent in our courts and that affected the relationship between animals and people. In this context, this act has introduced a provision that recognises the moral damage to the animal’s owners or cohabitants when the animal’s death or physical or psychological injury occurs. Based on these premises, this study aims to analyse section 4 of article 333 bis of the Civil Code. To this end, the assumptions for its application will be examined, as well as the main new features of this provision compared to the previous situation. |
