Según el artículo 2º de la Constitución, Venezuela se constituye en un Estado Social de Derecho que reconoce tanto el derecho a disfrutar de un medio ambiente adecuado, como el principio del desarrollo sustentable. Aunque esta ampliación constitucional deriva de su propia naturaleza jurídico-política, un sector de la doctrina la interpreta como una modificación estructural que implica, necesariamente, el advenimiento del Estado Ambiental de Derecho. Ahora bien, este artículo difiere de esa interpretación y reivindica la definición constitucional del Estado venezolano, proclive a incorporar nuevas demandas sociales, sin necesidad de modificar su denominación de “Estado Social de Derecho”. According to article 2 of the current Venezuela constitution 1999 this country is characterzed as a social state under the rule of law which upholds civil rights. In this context both the right to enyoy a protected enviroroment and the principle of sustainable development are recognized. The incorporation of new principles of law, corresponding to newly recognized interests must unddobtably be seen as a consequence of the legal political nature of the social state the which is always open to new possibilities. However, thes broadening of the scope of the constitution in considered by sone sections oh legal opinion as a structural modification which necessarily implies introducing the idea of an environmental state of law. In this article exception is take to this idea and the same time revindicates the constitution definition of the Venezuelan state which allows for new social demands to be take into account without any need for modifying the characterization of a social state under the rule of law. 67-87 camejias@ula.ve |
