Popis: | 現在、労働契約法20条と、「働き方改革」の主要な立法政策課題である「同一労働同一賃金」の間の異同・関係性が重要な課題となっている。本論文は、最近の裁判例(メトロコマース事件・東京地判平成29・3・23)を素材に両ルールの関係性を探りつつ、20条の解釈に際して「同一労働同一賃金」がいかなる意義を有するかについて理論的に考察する。 Recently, it has become a significant legal issue how Japanese Labor Contracts Act article 20 concerning prohibition of unreasonable labor conditions by providing a fixed term can normatively be situated in relation with the principle of equal pay for equal work, which is regarded as major legislative policy subject of work-style reform being promoted by Japanese Government.
