Popis: | Religious tolerance is a problem of interaction between different cultures and civilizations, as well as dialogue within cultures. The purpose of the article is to analyze the legal limits of religious tolerance, to determine the range of theoretical and practical problems of the principle of state neutrality in religious matters through the prism of a Court decision that requires legal regulation. The scientific novelty lies in the search for ways to reduce the conflict potential in modern Ukraine in connection with the frequent manifestations of intolerance between adherents of different religious worldviews and the integration of the State into the world community. Conclusions. The controversy over the placement of religious symbols in public places and the achievement of the right balance between competition rights (when minorities respect their religious freedoms and in many cases the religious majority struggles to maintain the status-quo in their privileged positions) is far from complete and needs further consideration in the context of interaction of international legal norms and national legislation. The approach to this issue must be ensured by national law, but the scope of discretion granted to the state is not always the same. Although the Court does not have to set uniform standards, it is still important for it to make recommendations on the guidelines that States should take into account when developing public policies, anti-discrimination laws and practices in order to fulfill their fundamental rights obligations. Religious tolerance is the means by which the European community finds its new features and raises questions about its own identity and the role of religion in its formation. The realization of the ideas of tolerance in the new conditions does not take place without the use of legal mechanisms. States at the present stage should strive to create a political and legal regime that best contributes to the strengthening of the ideas of tolerance in the public consciousness. Therefore, the relevant system of legal incentives and restrictions, prevention and legal liability for offenses in this area needs to be improved. |
