Popis: Cultural heritage is, without a doubt, one of the principles of preserving the civilization cultural diversity, as well as a powerful instrument for the cultures dialogue. Therefore, scientists from different countries paid great attention to the study of the theoretical and legal principles of its protection. Modern researches should be characterized by serious work on the development of a methodology and the theory of legal regulation of the protection of cultural heritage in the context of comprehension of foreign experience. The purpose of the article is providing, on the basis of the works analysis, the content characteristics of the tendencies of the western legal doctrine development in the sphere of cultural heritage protection. Scientific novelty consists of complex studying, systematization and classification of foreign scientific researches concerning protection, preservation and using of objects of cultural heritage. Conclusion. Problems in the sphere of the cultural and historical heritage protection exist in all countries, but they are constantly in sight of the state, society, and scientists who, using an interdisciplinary integrated approach, offer conceptual foundations for the preservation of cultural heritage. On the basis of the conducted analysis of the foreign researchers works, the classification of the subject of scientific researches, which is reproduced, partially or in complex, in this works, is proposed. It includes the general theoretical legal aspects of the preservation of the cultural heritage, the analysis of international legal regulation and its practical application with the background of real events of the modern world, as well as issues of legal protection of various aspects of the protection and using of cultural heritage, the state policy of foreign countries in this area. It is stated that the society strictly demands from the state to develop an effective system of measures for the protection of national and world cultural heritage, and scientists are actively involved in these processes. The protection of cultural heritage is a common problem of humanity, therefore the future development of this direction of social activity – is the international law of cooperation.
