Popis: | The Association for the Advancement of Civil Liberties (AACL) has on March 31st2023 expressed dissatisfaction with the National Council on Disability (NCD) processing of the Freedom of Information Act (FOIA) that was assigned Case No.: 2023 – 04. The AACL regrets the failure of the NCD to perform a more thorough search for responsive records detailing [1] the internal discussions that were had among employees of their federal government agency before contacting the Joint Commission on August 04th2021; [2] any documentary evidence in the form of notes and/or videos about the August 04th2021 meeting they have held with the Joint Commission; [3] the internal discussions that were had among employees of their federal government agency before contacting the Joint Commission on August 09th2021 (for the purpose of making recommendations to them); [4] the August 09th2021 NCD recommendations to the Joint Commission; [5] the discussions they have had with the Joint Commission about resolving complaints that are filed with them by health care workers and/or patients and/or clients, who have witnessed discrimination in the service of healthcare; [6] the discussions they have had with the Joint Commission about resolving complaints that are filed with them that raise potential Americans with Disabilities Act (ADA) as well as Health Insurance Portability and Accountability Act (HIPAA) issues. As you maybe aware, the Joint Commission had on April 23rd2014 informed Michael A. Ayele (a.k.a) W that 21 (twenty-one) written complaints were filed with them against the Fulton State Hospital (FSH) between April 24th2011 and April 23rd2014. These 21 complaints were filed against the FSH between April 24th2011 and April 23rd2014 for various reasons, which include but are not limited to the environment of care, the provision of care and the medication management there. In other words, once every two (2) months or so (between April 2011 and April 2014), a complaint or two were being filed with the Joint Commission against the FSH. For your information (FYI), the FSH is an agency component of the Missouri Department of Mental Health (MODMH) and via e-mail dated May 06th2021, the MODMH have refused to deny that 21 complaints had been filed against the FSH between April 24th2011 and April 23rd2014. Michael A. Ayele (a.k.a) W was an employee of the FSH during the second-half of Calendar Year 2013. He is also an alumnus of Westminster College (Fulton, Missouri).
