Popis: | In the present study, we analyze a case in which the conviction was ordered, among other things, for the offense provided for by Article 188 paragraph (2) letter e) of the Criminal Code of the Republic of Moldova (burglary committed with the weapon or other items used as weapons). As a result of the examination of the relevant doctrine and case-law, it is demonstrated that in the case, which is the subject of the present study, Article 78 paragraph (2) and Article 106 of the Contravention Code should have been applied. It is concluded that criminal law cannot be applied for causing material damage through deception or abuse of trust if the deed is not a theft and does not meet the elements of a crime, deed which caused a short-term health disorder or a slight, but stable loss of work capacity. The application of Article 188 paragraph (2) letter e) of the Criminal Code of the Republic of Moldova in such a case is nothing but the use of analogy in criminal law. |
