La présente contribution propose d’analyser et de caractériser, à la lumière du droit, la relation entre la laïcité et le vivre ensemble. Le communautarisme, puis le séparatisme supposé nourrir la radicalisation religieuse violente et ce qui est qualifié « d’atteintes à la laïcité » ont suscité de profondes interrogations au sein de la société française et contribué à la mobilisation de la notion de « vivre ensemble », en République. Pour faire face à ces « menaces » et pour renforcer le vivre ensemble, le législateur a accordé une place importante à la laïcité dans la loi confortant le respect des principes de la République. Partant, le rapport laïcité-vivre ensemble interroge le juriste. This paper proposes to analyse and characterize, from a legal approach, the relationship between laïcité and “living together”. Communitarianism, then separatism supposedly fuelling violent religious radicalization and the so-called “attacks on laïcité” have raised deep questions within French society and contributed to the mobilization of the notion of “living together” in the Republic. In order to deal with these “threats” and to strengthen living together, the legislator has given laïcité an important place in the Act of 24 August 2021 strengthening respect for the principles of the Republic. Therefore, the relationship between laïcité and living together raises questions for the jurist. |
