This article examines a number of cases of the European Court of Human Rights on the protection of environmental rights, freedoms and human interests, in which the human right to a healthy environment is indirectly recognized, the article also determines the nature of the right to a safe environment for life and health, its main theoretical and legal signs, the content of the human right to a safe for life and health environment or to a favorable environment, in particular, the features of the powers that are in its elemental structure, as well as the features of such powers, determined by the decisions of the above-mentioned international institution, are determined and systematized, it is noted the need to study other aspects and features of powers within the framework of the right to a healthy environment in the context of the practice of the European Court of Human Rights. This study was carried out due to the fact that the issue of the content of the right to a safe for life and health environment, determined by the practice of the European Court of Human Rights, is not sufficiently researched, and the components of such a right are not sufficiently consolidated and systematized in the domestic scientific literature. Clarification of the content of the right to a healthy life and health within the case law of the European Court of Human Rights in most studies is unsystematic, without taking into account all its components, as well as their relationship with theoretical and legal provisions. In addition, the features of the components of the aforementioned law have not been sufficiently considered, therefore, the purpose of this study is to study the practice of the European Court of Human Rights in terms of determining the content of the right to an environment safe for life and health, systematizing such components of the content of the above-mentioned right in accordance with the doctrinal and legal provisions determination of the features of the constituents of the content of the right environment safe for life and health. The author of the article used legal-technical, formal-logical and sociological methods in his work.   |
