Законодавче забезпечення охорони культурної спадщини у Франції: досвід для України

Popis: The purpose of the article is to analyze the French memorial legislation, identification of its features and the formation of proposals for possible borrowings in the process of improving the legal framework for the protection of cultural heritage in Ukraine. Scientific novelty. Attention is drawn to the basic regulations of the cultural heritage protection in France. Features of the French monument protection legislation; the basic principles of French institutions activity in the field of cultural heritage protection are revealed. The ways of improving the legislative protection of cultural heritage protection in Ukraine on the basis of borrowing French experience have been suggested. Conclusions. For almost two centuries, France has been pursuing a targeted state policy to protect the cultural heritage and improve its core legislation, having gained vast experience in this area. The French experience of legislative protection of cultural heritage protection is interesting for Ukraine, given the similar model of management in the field of culture, the existence of the state register of cultural heritage monuments, the policy of decentralization, etc. In the context of improving the legal regulation of the protection of cultural heritage in Ukraine, the French experience of the codification of specialized legislation deserves attention in the first place. The adoption of the Law "On patronage", which in France promotes the attraction of private funds for the protection and restoration of cultural heritage objects due to the preferential taxation of patrons, as well as the celebration of patrons at the state level and promotion of philanthropic activity, is also useful. In the process of decentralization in Ukraine, the French experience of transferring monuments on the ground to local self-government bodies under the general control of the state can be used. Equally necessary changes to the legislation are needed for the widest possible involvement of the public in the process of the cultural heritage protection, the implementation of public initiatives for the restoration of monuments. It is noteworthy and the practice of transferring objects of cultural heritage to the management of private companies provided that strict observance of the legislation on protection of monuments and the openness of these objects for the access of visitors.
