This study deals with the application of Napoleonic notarial law in the Kingdom of Italy during the period of french domination. Specifically, it investigates the adaptation of the Napoleonic law of 25 Ventoso year XI to the italian context, realised through the native law of 1806, which is intended to fill many gaps in transalpine legislation. The investigation then concerns the central role assumed by notaries in the legal framework of divorce by mutual consent, which was applied in a very strict manner in both France and Italy, as well as the importance assumed by notarial forms in the court cases examined. |
