| Popis: | La protección de los derechos humanos es una competencia compartida por los Estados, la ONU y los organismos internacionales especializados, los cuales, por medio de instrumentos jurídicos específicos como convenios y tratados establecen mecanismos de garantías de su ejercicio. En este texto se aborda la cuestión del acceso a internet como un derecho humano y como un derecho fundamental, pues, como consecuencia de los avances tecnológicos y la internacionalización del uso de internet, se ha convertido en la puerta de entrada hacia el ejercicio de otros derechos humanos. Ciertas normativas o resoluciones judiciales surgidas en Latinoamérica y Europa permiten apreciar una clara tendencia hacia el aseguramiento del ejercicio igualitario y efectivo del uso de la red por la ciudadanía. Para tratar este tema se procederá a describir y comparar los avances jurídicos internacionales en la materia y su probable integración en el conjunto de los derechos digitales. The protection of human rights is a competence shared by the States, the UN and specialized international organizations, which, through specific legal instruments such as conventions and treaties, establish mechanisms to guarantee their exercise. This text addresses the issue of internet access as a human right and as a fundamental right because, as a result of technological advances and the internationalization of internet use, it has become the gateway to the exercise of other rights humans. Certain regulations or judicial resolutions that have emerged in Latin America and Europe, allow us to appreciate a clear trend towards ensuring the equal and effective exercise of the use of the network by citizens. To deal with this issue, we will proceed to describe and compare the international legal advances in the matter and its probable integration in the set of digital rights.
