The Criminal code of the Republic of Moldova, in contrast with the criminal law of other states, does not provide liability for constitution of a terrorist group or a terrorist organization, which lead to some perspective problems in terms of differentiated and equitable punishment of complex forms of criminal participation, international legal cooperation, harmonization of national legislation with the provisions of international normative acts and legal instruments, etc. The main objective of the study is demonstration that art. 284, par. (2) of Criminal code (Creation or leading of a criminal organization or an organized criminal group for the purpose of committing one or more terrorist offenses) should be perfected on the background of necessity of an appropriate framework for combating terrorism. |
