The purpose of this article is to discuss the principle of good faith in business contracts, having as reference the case of the National Jute Fabrics Co. Cia Paulista de Aniagens. In this context, the authors review the concept of objective good faith and post-effectiveness of obligations. The approach methodology is analytical, empirical and critical: it starts with the analysis of legal and doctrinal concepts, it follows for an empirical verification before a practical case and develops, finally, argumentative criticism with a focus on the obligacional right. The expected results are to show that in the commercial contracts must be observed the duties of conduct arising from the principle of good faith; There is no mitigation of the duties attached to the legal business in the business sphere, only a differentiated effectiveness. |
