In the article investigational legal providing of introduction of the European standards in a sphere judicially legal adjusting of realization of the legal proceeding in civil cases. By the analysis of the basic legislative requirements to reformation of the judicial system of Ukraine, the necessity of harmonization of civil judicial legislation of Ukraine is grounded with the legal standards of European Union. The legal system of European Union functions on principles of unity. Before the Ukrainian state a task stands will confirm the unique with European Union standards of the civil legal proceeding. In accordance with the article of a 51 Agreement about partnership and collaboration between Ukraine and European Concord from June, 16, 1994, Ukraine must bring a national legislation to conformity with the legislation of European Union in different spheres. In the article attention of analysis of correlations of concepts is spared international principles of the legal proceeding and international standards of the legal proceeding. The author of the article draws conclusion that the standards of the legal proceeding show by itself the aggregate of norms, rules, procedures which are accepted to all right fastened a current in Ukraine legislation. Standards must execute the function of adjusting of procedure of consideration of civil cases the courts of Ukraine. Standards must provide availability of judicial defence for all citizens and possibility of implementation of court decisions. |
