Popis: In this article the conciliarist position which Nicholas of Tedeschi expounded between 1436 and 1439 in his capacity as representative of Alphonsus V of Aragon at the Council of Basel is analyzed. It considers opinions expressed in the tract Super Concilio Basiliensi which openly contradict those of Pope Eugene IV. These opinions had already been manifested in 1433 and are different to those which were sustained in the Questio Episcopus et quidam. It is deduced from this that the overall view responds affirmatively to the three questions which are put forward : 1) whether the Council represents the universal church; 2) whether the council can depose the pontiff; 2) whether the council can install another in the Apostolic See. In effect the tract gives an overview of the conciliarist position, that is, giving pre-eminence to the Council above the Pope. This being the view which had been previously rejected in the Questio. A certain incoherence is seen when the texts are examined on a theoretic level. Historically the pontifical position wins the argument, but it appears that the old controversy has not actually been answered
