THE BASICS OF THE LEGISLATION OF UKRAINE IN THE FIELD OF SPACE ACTIVITIES HAVE BEEN STUDIED

Popis: The provisions of the special Law of Ukraine "On Space Activities" dated November 15, 1996 No. 502/96- VR were analyzed, its shortcomings were identified, and the ways and prospects of innovative approaches to the adaptation of economic and special legislation to the modern realities of space activities were outlined. It was concluded that it is possible to talk about the imperfection of the reform of the space industry in Ukraine, proposed by the draft Law No. 1071 of 08/29/2019 "On Amendments to Some Legislative Acts of Ukraine Regarding State Regulation of Space Activities". Moreover, the latter should be recognized as unstable and unsystematic. It is proved that the reform requires the formation of a coherent economic order in the space industry, and the reform project itself should be based on the content of the agreed and socially accepted scientific concept of developing a national model of the space market economy in modern conditions. The absence of such a state-approved programmatic concept of space activity is one of the main factors of the existing chaotic-reactive nature of economic legislation, the consequence of which is the loss of systematicity and effectiveness of the legislative consolidation of the foundations of legal economic relations in the space industry both at the level of the Basic Law and in the norms of economic and related branches of the legislation of Ukraine. It is emphasized that solving the problem of economic and legal provision of space market economic relations, and therefore filling the conceptual gap of economic legislation in the space industry, lacks a national version of the economic and epistemological basis, andchaotic legislative outbreaks are one of the most important doctrinal problems of the development of economic law and legislation of Ukraine . In addition, it was noted that bringing the provisions of the legislation of Ukraine on space activities into compliance with international legal acts is a simple and really real process. If desired, this can be done in a shorter period of time than provided by the Concepts and Programs due to the development of a single strategy. Specific actions are needed in a short time. However, today is 2022, and the legislator has not yet adopted the Law of Ukraine "On State Regulation in the Field of Remote Sensing of the Earth", that is, he did not pay attention to the order of the Cabinet of Ministers of Ukraine of 2013. It was established that during the reformation of the commercialization of space activities in Ukraine, the subject of economic law expanded.
