The article describes the concepts and elements of the mechanism of administrative and legal protection of the animal world. It was determined that the mechanism of administrative and legal protection of the animal world is a system of means of protection applied by the public administration, within the limits of its competence, determined by the norms of law, for the purpose of development, preservation and rational use of the animal world. It was determined that the protection of the animal world is a complex system of legal means provided for by law, which, firstly, ensure a stable state of relations in the sphere of the animal world in an intact state, and secondly, are used to restore broken legal relations in the sphere of the animal world, to eliminate obstacles that interfere with their functioning. It is noted that the protection of legal relations in the sphere of the animal world is a set of measures, methods and techniques aimed at restoring the violated public law in the sphere of the animal world, by competent public bodies and officials, and the protection of legal relations in the sphere of the animal world is the activity of the public administration to create conditions, which contribute to the functioning and development of relations in the sphere of the animal world and prevent the commission of offenses in this sphere. The protection of legal relations in the field of the animal world is a component of the general (broader) concept of protection, which, along with the protection of the law, also includes mechanisms for its implementation and ways of preventing possible violations in the field of the animal world. The difference between the concept of protection and protection of legal relations in the sphere of the animal world can be traced in the fact that the protection of these legal relations is aimed at guaranteeing the grounds for acquiring public rights of legal relations in the sphere of the animal world, while the protection of legal relations in the sphere of the animal world is understood as specific actions aimed at renewing violated or contested right in this area. Elements of the mechanism of administrative and legal protection of the animal world are: a system of legal acts, which include international acts ratified by Ukraine and legal acts of Ukraine; public administration, endowed with powerful powers regarding the administrative and legal protection of the animal world; systems of means aimed at the realization of the main goal - development, preservation and rational use of the animal world. |
