Popis: This chapter begins with a discussion of justifications for both freedom of expression, including artistic expression, and censorship. Censorship initiatives are assessed under Article 19(3), which sets requirements for determining the extent to which restrictions on expression are permissible. The restrictions must be provided by law; they must have a legitimate aim (namely, protect the rights or reputations of others; protect national security, public order, or public health or morals); and they must be necessary. State censorship of music should be highly exceptional; nevertheless, as the human rights treaties remind us, the exercise of freedom of expression itself carries responsibility. This responsibility lies first and foremost with the musicians themselves but also with the music industry. An encouragement to self-regulation by the industry was issued in 2007 by the Hip Hop summit action network, which describes itself as the ‘world’s largest non-profit, non-partisan coalition of Hip Hop artists, entertainment industry leaders, education advocates, civil rights proponents and youth leaders’.
