Simplified Procedure for Consideration of Administrative Cases in Ukraine: Historical Way of Development and Current State

Popis: The article is dedicated to the 20th anniversary of the administrative justice establishment in Ukraine as a system of specialized administrative courts which are to protect rights, freedoms and interests of people in the field of public and legal relationship. The work supplies a complex historical and legal analysis of the procedure of simplified proceedings since introduction of the administrative justice in Ukraine. The author describes evolution of the court administrative procedure under the effect of social and political conditions in the country, discloses the essence of principal chronological changes which have happened in the simplified proceedings since the day of its implementation in the procedural administrative legislation, as well as outlines the next directions to simplify the court proceedings of administrative cases with consideration of present challenges. A particular attention is paid to the updated version of the Code of Administrative Procedure of Ukraine approved in 2017 which enshrines more flexible and dynamic administrating proceedings without prejudice to fulfilment of the main tasks of administrative justice. The author of the research concludes that the simplified court proceedings, introduced for faster administering justice in administrative cases and unloading administrative courts, is still a relevant and actual form of proceedings and solving administrative cases which, within a reasonable time, provides the juridical protection of rights, freedoms and interests of people, rights and interests of legal entities from violations by power authorities. It is confirmed that the planned measures on improvement of the rules of justice in Ukraine tend to further simplification of the procedure of administrative proceedings and updating of the judicial process in order to facilitate the access to justice for citizens and to raise efficiency of the judicial power in Ukraine.
