Popis: The article analyses the options for introducing common European rules on class action lawsuits with an opt-out-model in individual cases. An analysis is made of how the risks of misuse of class actions can be prevented. The article considers the Dutch rules on class settlements (the WCAM procedure) and the advantage of integrating equivalent rules into a European rule set. The Danish rules, which have now been in effect for some years, are then considered.
