Private Military (Security) Activity: Status and Prospects of International Legal Regulation

Popis: The purpose of this article is study of the phenomenon of private military (security) activity; its modern problems have been analyzed, ways of solution have been suggested. Methodology includes complex analysis and generalization of available scientific theoretical material with subsequent formulation of relevant concluding observations and recommendations. The following scientific methods were used during the research: terminological, historical, logical-semantic, systematic-structural. Findings. It has been established that private military (security) activity frequently trench upon mercenarism. Several states’ concernment in their role’s diminishment in armed conflicts (with simultaneous attempts to extend covertly their influence) is putting a dent on effectiveness of mercenarism counteraction by transformation of the latter into seemingly legal type of specific service industry. This in turn makes impossible quick cessation of hostilities, ruins the peace making process, and undermines the foundation of activity of the UN as the world most authoritative actor in the field of peaceful conflicts resolution. Therefore it is a question of high priority to implement measures to regulate private military (security) activity by drafting and adopting the relevant international legal act. Originality. The author’s definition of private military (security) activity has been formulated; the grounds for drafting of universal international legal act to regulate it have been suggested. Practical significance. The results of the study could be used in regulation making process during drafting and adopting of international legal act aimed to regulate private military (security) activity.
