Mt Elgon has been identified by the East African Community as a critical transboundary ecosystem that should be managed collectively to ensure the conservation of its habitats and the sustainable use of its resources. Kenya and Uganda manage the Mt. Elgon resources which fall within their borders and conservation measures include National Parks in each country and a forest reserve and trust land within Kenya. Currently, there are local, national, regional and international legal instruments that deal with the management of the Mt Elgon ecosystem. The crucial question which is the basis of this paper is how an effective legal framework can be developed for an effective and more sustainable management of Mt Elgon as a transboundary ecosystem. |
