On June 18 1996, in Case C-303/94, European Parliament v Council of the European Union, the European Court of Justice annulled Directive 94J43. This Directive laid down the "Uniform Principles for the evaluation and authorization of plant protection products" ("Uniform Principles") contained in Annex VI to Directive 91/414 on the placing of plant protection products on the market. This article provides a summary of the Court's ruling and an assessment of its impact on the functioning of EU legislation dealing with the approval of pesticide products. |
