The Joint Convention on the Safety of Spent Fuel Management and on the Safety of Radioactive Waste Management (Joint Convention) is the international framework providing guidance for developing and implementing a nuclear waste management program to contracting parties. This chapter discusses the impetus for creating this major milestone in international law for matters surrounding nuclear waste management, the main principles and objectives of the Joint Convention, as well as guidance to contracting parties in areas of safety, design, and siting of a nuclear waste facility. It further discusses issues relating to the functions of a regulatory body, and the need for legitimacy when promulgating the necessary statues, regulations, and rules. Finally, the obligations of contracting parties to ensure adequate financing is available for the various stages (i.e., design, construction, implementation, operation, and “care taker” phase) of a long-term geologic repository are discussed. |
