Over the past decades, lawmakers in continental Europe have displayed a particular interest in promoting methods of alternative dispute resolution (ADR). The European Union was a driving force behind this trend through the adoption of various directives, recommendations and regulations. Along with these efforts, national legislators have sought ways to encourage and institutionalise non-litigious dispute resolution as well. Both the supranational and national levels focus on creating comprehensive ADR regulation, raising awareness of the existence of ADR schemes (e.g. by disseminating information to the general public) and sometimes even on making ADR mandatory. This article addresses a way to support out-of-court dispute resolution which has not yet been considered in civil law systems: the introduction of apology legislation. |
