This chapter analyses the liability and time limitations in the Hague Rules, Hague-Visby Rules (pre-SDR protocol) and Hague-Visby Rules (as amdned by SDR Protocol). A brief comparison of the three Rules are undertaken and the availability of tonnage limitation is noted. In addition to the position in the UK (that has now subscribed to the third Rules), the position in Malaysia and Singapore are also considered, which have respectively subscribed to the first two Rules. The time limitation under Article III(6) and the time limitation for indemnity actions introduced in the Hague-Visby Rules by Article III(6)bis are considered at depth. The liability limitation schemes (package/gross weight limitations) under the three Rules are analysed in detail and a separate treatment for each set of Rules is given where necessary. Observation is made of the loss of protection in case of deviation. |
