Electric base-board heating systems are the cheapest to install and among the most expensive to operate. While home-owners rarely choose this type of system, the opposite is true of landlords. Depending on the region, electric base-board heaters are used in 53%-81% of residential rental units in Canada. Obviously tenant utility costs are low on landlords’ priority lists despite any impact they could arguably have on market rents for their units, and this brings about increased poverty and wasteful energy consumption. This paper examines the legal authority of Ontario municipalities to take action on this matter under the Municipal Act, 2001, S.O. 2001, c. 25 to restrict the use of base-board heaters in rental units, in conjunction with enforced maintenance of the “building envelope” in order to reduce heating costs and energy consumption through a business licencing scheme. |
