Popis: The following article deals with the case law of the European Court of Human Rights (ECtHR) on ensuringthe right to health as a right provided for by the European Convention on Human Rights (ECHR). The ECtHRhas dealt with cases concerning the health of persons who have alleged violations of their personal rightsunder the ECHR. The purpose of this article is to focus on the activities of the ECtHR and the impact of thepractice of this institution on national jurisprudence in matters related to medicine. The practical significanceof the study of the case law of the ECtHR is that the question of its application is a certain legal guidelinefor all law enforcement agencies - judges, lawyers, law enforcement officers and other participants. In thisstudy used the formal-logical method, method of analysis, synthesis, generalization, induction, deduction.Researched the practice of ECtHR to the right to health by protecting the right to life, the right to a fair trial,the right to respect for private and family life and the mechanism of the right to health in the ESHR.
