espanolResumen: Se examina el nacimiento y desarrollo de la opinion de los juristas, que en la cultura del derecho comun asumieron que los meritos y servicios pasaban a los herederos y que, en ciertos casos, podian cederse por actos entre vivos. El curso de esa opinion contribuyo a su progresiva “patrimonializacion”, es decir, a su consideracion como bienes que integraban el patrimonio de quien los habia adquirido o prestado. Esa opinion se reflejaba en una practica en Castilla, que se analiza en el caso concreto de letrados que habian servido en oficios con jurisdiccion. EnglishAbstract: This work analyses the genesis and development jurists’ opinions regarding the assumption that, in the common law system, the meritos y servicios were passed to heirs and that, in certain cases, it was possible to transfer them by means of inter vivos acts. This belief progressively led to the “patrimonialization” of the concept, that is, to consider it as an asset, a part of the heritage of those who had acquired it or lent it. This belief was put into practice in a Castilian case which is analyzed in the specific case of jurists that performed in offices with jurisdiction. |
