The necessary dialogue between Courts - in the vertical and horizontal axis - also allows the establishment of protective standard of criminal procedural guarantees, inserted under the criminal due process of law. The implementation of domestic regulations and jurisdiction in view of overcoming the domestic monologue, are requirements for an effective judicial protection. The effectiveness of criminal procedural guarantee requires legal, constitutional and, above all, conventional adherence under the pro homine principle. |
