Popis: Was the criminal legislation of Constantine influenced by Christianity? 1. To answer this question one must study not only the process of christianisation at the beginning of the 4th century, but also what Christians were thinking about criminal law at that time. This paper therefore is based on the examination of Christian literary texts together with the laws. 2. Some modern interpretations that have biased the reading of laws are criticised. Some scholars have argued that Christian ethics were institutionalised through forms of chastisement or new procedures. For example, the reasons why delation is abhorred by Christians have nothing to do with the reasons why delatores and calumnia are denounced in the laws. 3. A careful reading of Tertullian, Lactantius and Eusebius of Ceasarea shows that none of them has a developed conception of criminal law.
