Popis: | "It should be considered a great thing that today man, as man, is thought of as a holder of rights, and thus the human being as something greater than his status . . . Now, universal principles are in force as the source of law, and thus a new epoch has begun for the world" (Hegel). The declaration of the principles of the French Revolution in 1789 proposed judicial equality as the first hurdle: "Men are born free and remain free and equal in terms of rights." Article Six added, "The law is the expression of the general will ... It must be equal for all, in both protection and punishment." These principles were subsequently adopted in all of the European declarations and constitutions and sanctioned by the Universal Charter of the Rights of Man in 1948: "All men are equal under the law and have the right, without discrimination, to equal protection by the law." Equal protection is therefore not just under the law as an end and as representation, but also within the law; in other words, it is the allocation of fundamental rights to everyone: "Equality consists of the possibility for all to enjoy the same rights." |
