The article analyzes the legal support of the procedure for announcing the selection for the position of a judge, acceptance of documents and decision-making on admission to the competition as a stage of the selection procedure for the position of a judge. The results of the practice of the subjects of power in relation to their organization and provision have been studied, the shortcomings of their activity have been singled out. Substantiated proposals have been developed to improve this stage of this procedure, in particular: the need to develop a single Regulation on the organization and procedure for selection for the position of a judge, which is approved by the VRP and defines the stages of the selection procedure for the first time; indicated the need for enrollment as one of the eligibility criteria for the position of a judge - the presence of a doctorate (candidate) of law or a qualification degree of doctor of philosophy in the field of law, confirmed by a standard document; determined the right of a person who was previously dismissed from the position of a judge based on the results of the qualification assessment to apply for the position of a judge within three years from the moment of his dismissal, as well as in case of judicial recognition of the dismissal decision; clarify the list of documents submitted by a candidate for the position of a judge to the VKKSU by the right to provide, in addition to a copy of a military card (for servicemen or conscripts) - another standard document certifying the registration of a person or special registration of conscripts; to determine the right of a candidate for the position of a judge to submit documents to the VKKSU after the established term, if the person has provided convincing evidence of the objectivity of their untimely and incomplete submission; provide for the legislative possibility of appealing the decision of the VKKSU on the inadmissibility of a person to the selection of candidates for the position of judge, etc. |
