The formation of a common European market has raised a question of uniform relations regulations between air carriers and their passengers. The Passengers have been granted certain rights which are a subject to some challenge, whenever the air carrier cancels the flight or is delayed or denies the passenger’s right to board the aircraft. The legal standards are applied to the passengers departing from an airport located in the territory of a Member State. However, the legislator further extends the scope of the rules to passengers departing from an airport located in a third country to an airport located in the territory of a Member State, subject to two conditions, namely that the reciprocal service and assistance in that third country was not provided to a passenger, while an operating air carrier is a Community carrier. |
