The procedure adopted for selection of the leader in 1957 was almost fortuitous. It has been amply documented by those who took part in it. A discussion took place between Lord Kilmuir (Lord Chancellor) and Lord Salisbury (Lord President of the Council), ‘the senior members of the Cabinet whose position in the Lords left [them] unconcerned in the succession’. Lord Kilmuir writes: Having considered the constitutional position very carefully I had come to the conclusion that the Queen was entitled to ask for advice from anyone she chose in order to discover who would command the support of a majority in the House of Commons. I took the view very strongly that she need and ought not to wait for a party meeting. To do so would be to abandon the most important remaining part of her prerogative….1 |
