A escritura do processo penal e as influências da mídia em caso de repercussão nacional

Popis: The foundation of this research was architected interface between Textual Linguistics and Law, promoting some ramifications for Communication, Literature and Cinema, through interdisciplinary examination of the texture of criminal procedure that acquires national fame. In this direction, we present some answers to the following question: How has the media influenced the writing and the outcome of criminal proceedings that have great impact, as well as the activities of prosecutors, lawyers and judges working in these cases? From this problem, the main objective was traced to analyze the writing of parts of the prosecution's "Case Lindemberg", linked to the allegations of the prosecution and the defense, the prosecution and the production of the sentence, its elements (hyper) textual and media influences on reading / writing this dramatic crime story. Therefore, we adopted a qualitative methodology through literature on the theoretical concepts related to (hyper) textuality and collaborative writing, adjusted to the Brazilian criminal process, and the study of the media and their influence on popular opinion, highlighting is the theoretical Ingedore Koch, Mikhail Bakhtin, Roland Barthes, Pierre Levy, Michel Foucault, and in the area of law, the jurist Francesco Carnelutti and proceduralist Paulo Rangel. News sites and portals official agencies formed the basis of information about the object searched. Among the results obtained, highlighted the nature (hyper) textual interactivity and dialogism of procedural relationships and media interference dubious and controversial writing of the analyzed process, which resulted in violation of certain fundamental rights of the accused, spectacle case, manipulation of public opinion, bias and disproportionality of the trial application of the penalty.
