Investment Firms, Accountability, and the Effective Rule of Law

Popis: This chapter presents how the results of this book’s study confirm that there are a wide range of legal mechanisms for accountability within the regulatory framework on markets in financial instruments, and that some of these are more visible than others. It also demonstrates the crucial and sometimes novel role of investment firms: how such firms can be held accountable, but also hold EU agencies and national authorities to account for their actions or, indeed, appear in a dual role in a private law context. The chapter then considers the implications of these findings for EU law and the EU legal system. It also addresses how the findings contribute to the understanding of the concept of legal accountability in EU law, introducing the notion of an ‘infrastructure’ for accountability. The notion of an ‘infrastructure’ for accountability is a theoretical tool that is helpful to explain how the rule of law in the EU can be kept efficient by promoting and maintaining clear and precise pathways for accountability.
