Historically, coalbed methane was considered to be a danger to coal miners and a hindrance to coal mining in general. It was not until the latter part of the last century with emerging technology that coalbed methane began to be viewed as a valuable resource that could be developed independently. This revelation, and the resulting commercial production of the mineral, has raised several legal issues not present with the normal development of minerals such as coal or natural gas. These issues have required statutory guidance, judicial interpretation, and greater attention to written agreements among the parties seeking to develop the methane. |
