International Versus National Framework of Legal Protection of Performerss Right in Nigeria

Popis: The territorial nature of intellectual property enhances its effectiveness only within the national boundaries of a state. Much of the national legislation on copyright promulgated by a state is derived from rules of international application as well as from its experience and needs. This paper highlights the development over time internationally through the Berne Convention of 1886, Rome Convention of 1961, the Agreement on Trade- Related Aspects of Intellectual Property Rights, 1994, the WIPO Performances and Phonograms Treaty (WPPT), 1995 and the Beijing Treaty on Audio-visual Performances (BTAP), 2012 and found as a fact that although the Nigerian Copyright Act is modeled after the Rome Convention of 1961, the obligation of Nigeria under the Rome Convention in respect of performers has not been fully implemented by Sections 26-30 of the Nigeria Copyright Act.
