Constitutionalism as a concept is the gathering of the rules concerning the basic organization of the state in one form. This is a result of liberal state understanding. Although the basic principles of the administrative regime are in the constitution of each country, there is no application that we can say that is the most effective and rational administrative regime all over the world. According to the conditions of the countries, the historical past and the political culture, the power to use sovereignty can be shaped. In our country which has a tradition of statehood, the Parliamentary System, which does not have any social foundations and occupies the agenda of the country for a long time, will undergo a major change with the new constitutional amendment. With the executive power passing to the president, the dualist structure is emerging from the middle and the separation of powers is more evident. With the abolition of the Council of Ministers, all the authorities are passed to the President. Again, minimizing the dependency between the executive and the legislature, the administrative authority of the executive and the expansion of the jurisdiction are among the most important firsts. The authority of the establishment and removal of ministries and the appointment and removal of senior bureaucrats has been given to the president. The aim of this study is to analyze the administrative reflections of the executive and its possible consequences in the system introduced by the new regulation. In the study, new cases will be compared with the old situation and examples will be presented from country applications in some places. |
