The paper deals with the complex adaptation of the legal categories relating to social insurance against industrial accidents and occupational diseases to the space-time flexibility of smart working. In particular, the essay aims at demonstrating how this flexibility, together with the enhancement of personal needs of work-life balance that characterizes smart working, significantly affects some key concepts of the subject regulated by d.p.r. n. 1124 of 30 June 1965, also affecting the insurance protection due to employees. The result is a strong tension between two opposing values: flexibility and health and safety at work, values on which the effective work-life balance of smart workers mostly depends. |
