Proponitur quaestio utrum hoc Decretum ratificationis pertineat ad processum cognitionis an ad processum exsecutionis. Differentia quae datur inter actus processales documentationis et documentum, inter actum iudicialem decisionis et titulum iussumque exsecutionis animadvertitur. Statim examinantur diversae formae decisionum iudicialium et agitur de pertinente ad exsecutorietatem decisionum iudicialium et ad modum exsecutionis. Concluditur naturam 'huius Decreti esse iudicialem, non yero administrativam. Responditur ab obiectiones.--------------------------------------- Abstract In this paper, the author enumerates seventeen arguments in favor of the administrative-ejecutive carácter of the Decree ratifying the afirmative sentence in cases of matrimonial nUllity, in accord with Pope Paul Vl's Motuproprio «Causas matrimoniales». The question is raised as to whether the decree of ratification pertains to processus cognitis or to pro• cessus exsecutionis. The author points' out the difference between the procedure of documentation and the instrument; as well as the differences among the judicial act of decision, the title and the ejecutive decree. Subsequently, the distinct types of judicial decisions are examined, and the authorconsiders all the procedures involved in carrying out these decisions. The conclusion is that the Decree is of a judicial,and notadministrative, nature. The objections to this statement meet their response in the paper. |
