Med udgangspunkt i nutidens daytrader, der sidder ´"bag skærmen" og foretager talrige daglige køb og salg af børsnoterede aktier mv., analyseres det i artiklen, hvornår en sådan lovlig daytrading udarter til strafbar kursmanipulation. Nogle daytradere har ment, at hvis en ikke-professionel investor sidder bag skærmen og afgiver handelsordrer, må han være straffri - men dette er ikke korrekt, når handlemåden betragtes i lyset af forbuddet mod kursmanipulation. Artiklen inddrager praksis fra danske landsretter. Daytraderen må lægge bånd - ikke om sin sko, men på sig selv og sit tastatur. With present days' daytrader, who sits "behind the screen" (referring to a traditinal Danish folksong about the poor Jens Roadman sitting behind his working screen) and executes numerous daily buys and sells of listed shares etc., the article analyses when such trading shifts caracter and becomes criminal share-pushing. Some daytraders would seem to have assumed that if a non-professional trader sits "behind his screen" and issues trading orders, he must per se act in a legal way - but this is not correct when his way of acting is regarded in the light of the provisions forbidding share-pushing. The article refers to case law from the Danish appeal courts. The daytrader must (again with hidden reference til the folksong about the poor Jens Roadman) "tie and restraint - not around his shoes - but himself and his keyboard". |
