Popis: Though criminal in character, domestic violence is usually considered as a civilissue, particularly when in the context of Family law. This is usually the case as matrimonial conflicts, (mainly when there is physical or psychological aggression) frequently result in profound crisis for the parties involved usually leading to judicial procedure to divorce, separate or nullify the matrimonial link, coupled with previous requests of provisional or definitive measures to assure the proper development ofthe aforementioned procedure.This article is aimed, firstly, at analysing the legal system on divorce and separation that existed before the amendment of the Civil Code which took place on 8th July, 2005. According to the legal system at that time, domestic violence was already,a fact that could be used as a legal base in the hands of the victim that allowedhim/her to submit a plaint to divorce or to separate. Secondly, this article examines the above mentioned amendment of the Civil Code, particularly those parts relatedto domestic violence. Thirdly this article examines the legal measures available toface domestic violence, and the jurisdiction on civil questions arising from domestic violence and related aspects, on which the courts on domestic violence are competent.Finally, some important procedural questions are discussed. These include: (i) cases in which both Civil and Domestic Violence Courts lose competence, (ii) specificcases when the plaint can be rejected, and (iii) territorial jurisdiction and jurisdictional conflicts. La violencia doméstica siempre ha tenido una íntima vinculación con cuestiones civiles, dentro del ámbito del derecho de familia. Los conflictos matrimoniales, sobre todo si existe violencia -física o psicológica – son causa de una crisis conyugal profunda que culmina materializándose en un proceso judicial. En este estudio, tras exponer la regulación anterior a la última reforma del C. Civil, se estudia la vigente Ley de 8 de julio de 2005, en el ámbito especifico de la violencia en el seno de la familia, para terminar analizando la Ley Orgánica 1/2004 de 28 de diciembre, de medias de protección integral contra la violencia de género, especificando la competencia civil de los juzgados de violencia sobre la mujer, en su amplia y compleja problemática.
